FORECLOSURE SALE
Default having been made in the payment of indebtedness secured by that certain mortgage executed by Martin Herrera and Silvia Arzola, husband and wife, on the 26th day of June, 2008 to West Alabama Bank & Trust which said mortgage is recorded in the Probate Office of Marion County, Alabama, in Mortgage Record Volume 2008, at Page 3025 and re-recorded in Mortgage Record Volume 2008, at Page 3110, on the 14th day of July, 2008, and by reason of such default, having declared all of the indebtedness secured by said mortgage due and payable, and such default continuing, notice is hereby given that, acting under the power of sale contained in said mortgage, West Alabama Bank & Trust will sell at public outcry, for cash, to the highest bidder, before the front entrance of the Courthouse in the City of Hamilton, Marion County, Alabama, at 12:00 o’clock noon or otherwise during the legal hours of sale on February 10, 2012 the following described real estate situated in Marion County, Alabama, to-wit:

Together with the hereditaments and appurtenances thereunto belonging and all fixtures now attached to and used in connection with the premises herein described.
Said sale will be subject to the right of way easements and restrictions of record in the Probate Office of Marion County, Alabama, and will be subject to existing special assessments, if any, which might adversely affect the title to subject property.
