MORTGAGE FORECLOSURE NOTICE
Default having been made in the terms of that mortgage executed on the 24th day of June, 1996, by Danny Cole and wife, Tammy Cole, to CB&S Bank, formerly known as Citizens Bank & Savings Company, Russellville, Alabama, which said mortgage is recorded in the Office of the Judge of Probate of Marion County, Alabama, in Mortgage Volume 533, Page 196, and default continuing and by virtue of the power of sale contained in said mortgage, the following described property will be sold to the highest bidder for cash, in front of the Courthouse doors of said County, during the legal hours of sale, on the 10th day of February, 2012.
The property located in Marion County, Alabama, and described in said mortgage is as follows, to-wit:
A tract of land containing 1.44 acres, situated in the West ½ of the Southwest ¼ of Section 17, Township 9 South, Range 12 West, Marion County, Alabama, more particularly described as follows:  Commence at the Southwest corner of said Section 17; thence run North 00 degrees 00 minutes West along the West boundary of said Section 17, a distance of 1274.61 feet to a point on the West side of a paved city street; thence run North 72 degrees 39 minutes East, across said street, a distance of 27.98 feet to an old axle situated the East base of a creosote post fence corner, said axle being the point of beginning for the tract herein described to-wit; thence continue North 72 degrees 39 minutes East a distance of 367.92 feet to a capped rebar situated on the Westerly right of way of the Old Hackleburg-Fairview Public Road (a paved city of Hackleburg street)(40.0 foot R.O.W. indicated); thence run South 06 degrees 56 minutes East along the Westerly right of way of said road, a distance of 74.72 feet to a P.I. point; thence run South 03 degrees 09 minutes East and continue along the Westerly right of way of said road, a distance of 115.70 feet to a point that is situated South 72 degrees 51 minutes West of and 5.31 feet from an old one-inch diameter solid iron pin (buried in the corner of an old hedgerow); thence run South 72 degrees 51 minutes West a distance of 306.49 feet to an old one-inch diameter iron pipe situated at the base of an old cedar fence post corner; thence run North 23 degrees 29 minutes West along an old web wire and barbed wire fence a distance of 185.76 feet to the point of beginning.
Said sale is made for the purpose of paying the mortgage debt and cost of foreclosure and will be conducted by McDowell, Beason & Hamilton, P.C., Attorneys at Law, P. O. Box 818, Russellville, Alabama.
This sale will be made subject to any existing Junior Federal Tax Liens and unpaid ad valorem taxes, if any.

RESOLUTION
WHEREAS, the County Commission of Marion County, Alabama, proposes  that the public interest will be served by receiving public information on the consideration of the vacation of the public highways herein described;
NOW, THEREFORE, BE IT RESOLVED BY THE COUNTY COMMISSION OF MARION  COUNTY, ALABAMA, That a public hearing shall be scheduled at the Commission  Office located in the Marion County Courthouse on the 12th day of March,  2012, at 9:00 a.m. for the purpose of receiving the public’s input on said vacations; and
BE IT FURTHER RESOLVED, That the Commission Chairman and County Clerk are hereby authorized and directed to publish notice of said public  hearing in The Journal Record once a week for four consecutive weeks, said notice shall be substantially as follows:
On the 12th day of March, 2012, at 9:00 a.m., the Marion County Commission will hold a public hearing at the Commission Offices located at 119 Military Street North, Hamilton, Alabama, on the County’s proposal on an  unnamed public road more specifically described as follows:
ROAD ONE:
Begin at the intersection of the easterly right of way boundary of Co. Hwy 61 and Co. Rd 468, proceed thence in a easterly direction along Co.  Rd 468 (an unpaved road) for approximately 3500 ft. to the intersection of the westerly right of way boundary of Co. Hwy 68. Said road is located  partially in sec. 16, 17, 20, and 21 T12S, R12E, Marion Co. AL.

On the 12th day of March, 2012, at 9:00 a.m., the Marion County Commission will hold a public hearing at the Commission Offices located at 119 Military Street North, Hamilton, Alabama, on the County’s proposal on a portion of the Leborn Kennedy Road more specifically described as follows:
ROAD THREE:
Beginning at a point on the westerly right-of-way of Tessner Road (County Road 45) and the old Leborn Kennedy Road (approximate GPS coordinate N 34°15.711’, W 087° 47.263’) thence proceed in a northwesterly direction along the existing centerline of the Old Leborn Kennedy Road for a distance of approximately 1545 feet to the intersection of the new Leborn Kennedy Road and the point of termination of the road herein vacated.   (Approximate GPS coordinate N 34°15.735’, W 087° 47.517’) Said road is located in the SW¼ NW¼ of Section 22 and SE¼ - NE¼ of Section 21, Township 9  South, Range 12 West, Marion County, Alabama.
On the 12th day of March, 2012, at 9:00 a.m., the Marion County Commission will hold a public hearing at the Commission Offices located at 119 Military Street North, Hamilton, Alabama, on the County’s proposal on a portion of an unnamed public road more specifically described as follows:
ROAD FOUR:
Beginning at a point in the center of an unnamed public road approximately 600 feet northeast of Marion County Highway 167 (approximate GPS coordinated N 34°15.918’, W 087° 53.955’) located in the South½ of the NE¼ of the NE¼ of Section 21, Township 9 South, Range 13 West, Marion County, Alabama, being the point of beginning of the road herein described. Proceed thence in a northeasterly direction along the centerline of said road a distance of approximately 5450 ft. to the point of termination (as shown on the attached map). Said road is located in Section 21, Section 22, Section 15, Township 9 South, Range 13 West, Marion County, Alabama.
BE IT FURTHER RESOLVED, That the Commission Chairman and County Clerk are hereby authorized and directed to post a copy of said notice on a bulletin board at the Marion County Courthouse and in the Office of the County Commission;
BE IT FURTHER RESOLVED, That the Commission Chairman and County Clerk are hereby authorized and directed to serve a copy of said notice by United States Mail, at least 30 days prior
