MORTGAGE FORECLOSURE SALE
Default having been made in the terms of that mortgage executed on the 6th day of June, 2008, by JULIAN T. OLIVE, a married man and S. M. BOOTH, a single person, as mortgagors in favor of State Bank and Trust, as mortgagee, which said mortgage is recorded in the Office of the Judge of Probate, Marion County, Alabama, in OFFR Book 2008 at Page 2678; and State Bank and Trust, as mortgagee, having declared all of the indebtedness secured by said mortgage due and payable and such default continuing, notice is hereby given, that acting under and by virtue of the power of sale contained in said mortgage, State Bank and Trust, as mortgagee, will sell at public outcry, for cash, to the highest bidder, in front of the West door of the Courthouse in Hamilton, Marion County, Alabama, during the legal hours of sale, on JULY 7, 2025, the following described real estate, together with hereditaments and appurtenances there unto belonging and all fixtures now attached to and used in connection with the premises herein described, to-wit:
That certain parcel of real property recorded in the Probate Court of Marion County, Alabama, at Volume 272 at Page 572, more properly described as follows: Beginning at the Southwest corner of the NW ¼ of the NW ¼ of Section 35, Township 12 South, Range 12 West; thence North 3° 08 minutes 30 seconds West along section line a distance of 312.50 feet to an iron pin; thence South 89° 29 minutes 17 seconds East a distance of 707.77 feet to the west right of way of AL State Highway #129; thence South 1° 48 minutes 34 seconds East along said West right of way of AL State Highway #129 a distance of 312.12 feet to an iron pin; thence North 89° 29 minutes 17 seconds West a distance of 700.50 feet to the point of beginning.
LESS AND EXCEPT: A part of the NW ¼ of NW ¼ of Section 35, Township 12 South, Range 12 West, Marion County, Alabama, identified as Tract No. 78 on Project No. STPAA-474(3) and more fully described as follows: Commencing at the southwest corner of the NW ¼ of NW ¼, Section 35, Township 12 South, Range 12 West, thence easterly along the south line of said NW ¼ of NW ¼ and the south property line of the property herein to be conveyed a distance of 235.2 meters, more or less, to the present southwesterly right of way line of Alabama Highway No. 129 and the point of beginning of the property herein to be conveyed; thence northwesterly along said present southwesterly right of way line a distance of 79.7 meters, more or less, to the north property line; thence westerly along said north property line a distance of 12.9 meters, more or less, to a point on a curve that is 28.0 meters southwesterly of, and parallel to, the centerline of said project; thence southeasterly along said curve to the right, parallel with the centerline of said project a distance of 79.7 meters, more or less, to the south line of said NW ¼ of NW ¼ and said line being the south property line; thence easterly along said south property line a distance of 12.76 meters, more or less, to the point of beginning. Said strip of land lying in the NW ¼ of NW ¼ Section 35, Township 12 South, Range 12 West, Marion County, Alabama.
Said property will be sold on an "as is, where is" basis subject to any easements, encumbrances, and exceptions contained in said mortgage and those contained in the records of the Office of the Judge of Probate where the above-described property is situated. Said property will be sold without warranty or recourse, expressed or implied as to title, use and/or enjoyment and will be sold subject to the right of redemption of all parties entitled thereto. This sale is made for the purpose of paying the mortgage debt, cost and expense of foreclosure.
