MORTGAGE FORECLOSURE SALE
Default having been made in the payment of the indebtedness secured by that
certain mortgage executed by Laura Allman, a single person, to Sebring Capital
Corporation, on the 2nd day of November, 2000, said mortgage recorded in the
Office of the Judge of Probate of Marion County, Alabama, in Book 715, Page
001; said mortgage having subsequently been transferred and assigned to Bank
One, National Association as Trustee, by instrument recorded in Book 747, Page
242, in the aforesaid Probate Office; the undersigned The Bank of New York
Trust Company, N.A., as successor to JP Morgan Chase Bank, N.A., successor by
merger with Bank One, N. A., as trustee for that certain pooling and servicing
agreement, Series # 2001-KS1, Pool # 4493, as Mortgagee/Transferee, under and
by virtue of the power of sale contained in said mortgage, will sell at public
outcry to the highest bidder for cash, in front of the main entrance of the
Courthouse at Hamilton, Marion County, Alabama, on June 12, 2008, during the
legal hours of sale, all of its right, title, and interest in and to the
following described real estate, situated in Marion County, Alabama, to-wit:
Lot No. 4, in Block A of the D.F. Mobley Addition to the Town of Guin, Alabama,
as per the plat which is recorded in the Marion County Probate Office in Map
Book 1, at page 21. Property dimensions are: 263 feet on the South line; 102
feet on the West line, 287 feet on the North line; and 102 feet on the East
line.
Less and except:
All of that part of Lot No. 4 in Block A of the D.F. Mobley Addition to the Town
of Guin, Alabama, as per the plat which is recorded in the Marion County
Probate Office in Map Book 1, page 21, which lies North of the North line of
13th Avenue as its presently exits
THIS PROPERTY WILL BE SOLD ON AN “AS IS, WHERE IS” BASIS, SUBJECT TO ANY EASEMENTS, ENCUMBRANCES, AND EXCEPTIONS REFLECTED IN THE
MORTGAGE AND THOSE CONTAINED IN THE RECORDS OF THE OFFICE OF THE JUDGE OF
PROBATE OF THE COUNTY WHERE THE ABOVE-DESCRIBED PROPERTY IS SITUATED.
THIS PROPERTY WILL BE SOLD WITHOUT WARRANTY OR RECOURSE, EXPRESSED OR IMPLIED AS
TO TITLE, USE AND/OR ENJOYMENT AND WILL BE SOLD SUBJECT TO THE RIGHT OF
REDEMPTION OF ALL PARTIES ENTITLED THERETO.
This sale is made for the purpose of paying the indebtedness secured by said
mortgage, as well as the expenses of foreclosure.
The Mortgagee/Transferee reserves the right to bid for and purchase the real
estate and to credit its purchase price against the expenses of sale and the
indebtedness secured by the real estate.
