Default having been made in the terms of that certain equitable mortgage as set forth in the decree of the Circuit Court of Marion County, Alabama, in the case of Floyd Alan Newell vs. David Channell and Kimberly Channell, being Case No. CV-2013-900179, dated January 7, 2015, and amended by decree dated January 26, 2015, and default continuing, and by virtue of the power of sale contained in said decree the following described property will be sold to the highest bidder for cash, on the 15th day of March, 2023.
The property located in Marion County, Alabama, and described in said decree is as follows: All that part of the S 1/2 of NW 1/4 of Section 11, Township 9 South, Range 14 West, Marion County, Alabama, that lies East of the Chickasaw boundary line; containing 58 acres, more or less. Beginning at the intersection of the North boundary line of Section 11, Township 9 South, Range 14 West with the East right of way line of a county paved highway; thence East along the North boundary line of said Section 11 to the Old Chickasaw boundary line; thence Southwesterly meandering along said Old Chickasaw boundary line to the East right of way line of a county gravel road; thence Northely along the East right of way line of said gravel road to the South right of way line of said county paved highway; thence Northeasterly along the South right of way line to the point of beginning, containing 21.15 acres more or less. LESS AND EXCEPT ALL MINERAL AND MINING RIGHTS. Said sale is made for the purpose of paying the mortgage debt and cost of foreclosure and will be conducted by McDowell, Beason & Hamilton, P.C., Attorneys at Law, P.O. Box 818, Russellville, Alabama 35653. This sale will be made subject to any existing Junior Federal Tax Liens and unpaid ad valorem taxes, if any.
