Trial date set after Brumley indictment

HAMILTON — Keith Brumley, 63, of Hackleburg, was indicted on April 24, 2024, on charges of use of official position or office for personal gain and theft of property, first degree.
According to the indictment documents a grand jury found there was sufficient evidence Brumley, as the director of transportation and maintenance for the Marion County Board of Education (MCBE), used his position to obtain property for his own personal use.
Some of the items he allegedly obtained included air conditioning units, heaters, propane tanks, frost free hydrants, water heaters, doors, tires and miscellaneous auto parts and supplies intended for MCBE use.
According to the prosecution, Brumley illegally obtained this property over the course of several years from April of 2020 to September of 2022.
According to the Code of Alabama Section 36-25-5: “No public official or public employee shall use or cause to be used his or her official position or office to obtain personal gain for himself or herself, or family member of the public employee or family member of the public official, or any business with which the person is associated unless the use and gain are otherwise specifically authorized by law.
“Personal gain is achieved when the public official, public employee, or a family member thereof receives, obtains, exerts control over, or otherwise converts to personal use the object constituting such personal gain”…
