Default having been made under the terms of that certain mortgage executed by Rodney Scott Thompson, a married man, on the 11th day of June, 2018 to PeoplesTrust Bank, predecessor to Barrett Marion Holdings, LLC, which said mortgage is recorded in the Probate Office of Marion County, Alabama, in Book 2018, at Page 2270 and subsequently assigned to Barrett Marion Holdings, LLC in that certain Nonrecourse Assignment of Note and Mortgage recorded in the Probate Office of Marion County, Alabama, in Book 2024 at Page 4711, and by reason of such default, having declared all of the indebtedness secured by said mortgage due and payable, and such default continuing, notice is hereby given that, acting under the power of sale contained in said mortgage, Barrett Marion Holdings, LLC, assignee of PeoplesTrust Bank, will sell at public outcry, for cash, to the highest bidder, before the main entrance of the Courthouse in the City of Hamilton, Marion County, Alabama, at noon or otherwise during the legal hours of sale on May 28, 2024 the following described real estate situated in Marion County, Alabama, to-wit:
A tract of land containing 23.96 acres, more or less, situated in the SE ¼ of Section 14, Township 10 South, Range 16 West, Marion County, Alabama, more particularly being described as follows, to-wit: Beginning at the Northeast corner of the SE ¼ of said Section 14, which said NE corner is marked by a 1.75 inch iron pipe and a pine knot; thence run South 00° 29’ 00” East a distance of 1,294.49 feet to an iron pin; thence run South 88° 42’ 00” West a distance of 1,052.08 feet to the center of a county public road; thence run North 38° 10’ 00” East a distance of 243.84 feet; thence run North 50° 43’ 00” East, continuing along the center of said road, a distance of 140.88 feet, thence run North 48° 21’ 00” East, continue along the center of said road a distance of 81.32 feet to a rail road spike located in the center of said road; thence run South 73° 34’ 00” West a distance of 158.66 feet to an iron pin; thence run North 71° 45’ 00” West a distance of 121.02 feet to an iron pin; thence run North 62° 56’ 00” West a distance of 91.58 feet to an iron pin; thence run North 75° 42’ 00” West a distance of 120.78 feet to an iron pin; thence run North 84° 18’ West a distance of 103.95 feet to an iron pin; thence run North 35° 58’ 00” West a distance of 126.64 feet to an iron pin; thence run South 89° 26’ 00” West a distance of 181.54 feet to a rock corner, the Southwest corner of the Archlancy Griffin land; thence run South 87° 50’ 00” West a distance of 87.00 feet to an iron pin; thence run South 80° 00’ 00” West a distance of 59.58 feet to an iron pin; thence run South 41° 47’ 00” West a distance of 75.66 feet to an iron pin; thence run South 23° 27’ 00” West a distance of 107.84 feet to an iron pin; thence run South 12° 20’ 00” West a distance of 242.65 feet to an iron pin; thence run North 89° 53’ 00” West a distance of 607.17 feet to a rock corner located on the East boundary of the tract of land owned by R. P. Goggans; thence run South 06° 02’ 00” West, making an interior angle of 96° 01’ 00” and running along the East boundary of said R. P. Goggans land a distance of 353.11 feet to an old steel post; thence run South 86° 08’ 00” East a distance of 468.04 feet to an old steel post; thence run South 09° 55’ 00” West a distance of 255.38 feet to an old steel post located on the Westerly side of said county public road; thence run South 72° 30’ 00” East a distance of 27.85 feet to the center of said public road; thence run East and Northeasterly, along the center of said public road, to the point of beginning of the tract herein described.
Together with the hereditaments and appurtenances thereunto belonging and all fixtures now attached to and used in connection with the premises herein described.
Said sale will be subject to the right of way easements and restrictions of record in the Probate Office of Marion County, Alabama, and will be subject to outstanding property taxes, and existing special assessments, if any, which might adversely affect the title to subject property.
Said property will be sold on an “As Is, Where Is” basis without warranty or recourse, express or implied as to title, use and/or enjoyment. Neither the mortgagee, nor the officers, directors, attorneys, employees, agents or authorized representative of the mortgagee make any representation or warranty relating to the title or any physical, environmental, health or safety conditions existing in, on, at or relating to the property offered for sale. Any and all responsibilities or liabilities arising out of or in any way relating to any such condition, including those suggested by Code of Ala. (1975) §35-4-271, are expressly disclaimed.
Said sale will be made for the purpose of paying the indebtedness secured by the above described mortgage, and the proceeds thereof will be applied as provided by the terms of said mortgage. The successful bidder must tender a non-refundable deposit in certified funds made payable to Reynolds, Reynolds & Little, LLC at the time and place of the sale. The balance of the purchase price must be paid in certified funds or by wire transfer by 5:00 p.m. the next business day at the Law Office of Reynolds, Reynolds & Little, LLC at the address indicated below unless prior to said sale Reynolds, Reynolds & Little, LLC has agreed to a later date or closing location. The Mortgagee reserves the right to bid for and purchase the real estate and to credit its purchase price against the expenses of sale and the indebtedness secured by the real estate.
The failure of any high bidder to pay the purchase price and close this sale shall, at the option of Mortgagee, be cause for rejection of the bid, and if the bid is rejected, Mortgagee shall have the option of making the sale to the next highest bidder who is able, capable and willing to comply with the terms thereof.
This sale is subject to postponement or cancellation..
