Default having been made on the terms of that certain mortgage executed by Terry Lou Aaron, Jr. and Jessica Hassell Aaron, a married couple, to First National Bank, Hamilton, on the 3rd day of December, 2014, and recorded in Volume 2014 of Mortgages at Page 4439 in the Office of Judge of Probate of Marion County, Alabama, and default still continuing and by virtue of the power of sale contained in said mortgage, the following described real estate situated in the County of Marion, State of Alabama, will be sold at public auction to the highest bidder for cash at the Main Entrance of the Courthouse of Marion County, Alabama, during the legal hours of sale on the 3rd day of May, 2024.
A tract of parcel of land in the NE ¼ of NW ¼ of Section 3, T 11, R 12 West, more particularly described as follows: Commencing at the northwest corner of said forty, thence South along the West line of said forty a distance of 175 yards, more or less, to State Highway, thence East along said highway a distance of 320 yards, more or less, to the branch, then north along said branch 175 yards, more or less, to the north line of said forty, thence west along the north line of said forty to the point of beginning.
THIS PROPERTY WILL BE SOLD ON AN "AS IS, WHERE IS" BASIS, SUBJECT TO ANY EASEMENTS, ENCUMBRANCES, AND EXCEPTIONS REFLECTED IN THE MORTGAGE AND THOSE CONTAINED IN THE RECORDS OF THE OFFICE OF THE JUDGE OF PROBATE OF THE COUNTY WHERE THE ABOVE-DESCRIBED PROPERTY IS SITUATED. THIS PROPERTY WILL BE SOLD WITHOUT WARRANTY OR RECOURSE, EXPRESSED OR IMPLIED AS TO TITLE, USE AND/OR ENJOYMENT AND WILL BE SOLD SUBJECT TO THE RIGHT OF REDEMPTION OF ALL PARTIES ENTITLED THERETO.
Said sale will be made for the purpose of paying the mortgage indebtedness and costs of foreclosure.
